Article 49 of Inheritance Law No. 77 of 1943, added by Law No. 219 of 2017, addresses intentional refusal to deliver an heir’s lawful inheritance share, withholding a document confirming an heir’s share, and refusing to deliver that document when requested, subject to the facts and evidence.
Not every disagreement between heirs is automatically a crime. Entitlement, the disputed assets or documents, possession or control, the nature of the refusal and intent require assessment in the circumstances of the case.

What Is the Penalty for Withholding Inheritance in Egypt?
Without prejudice to a more severe penalty under another law, Article 49 provides for imprisonment of at least six months and a fine of EGP 20,000 to EGP 100,000, or either penalty, for conduct covered by the provision. For a repeat offense, the stated minimum imprisonment is one year.
